Oh, patents! Rothy's 4 kids

Copyright © Françoise Herrmann

Also knitted out of yarn made from recycled plastic bottles, Rothy’s kids shoes come in the cutest loafers and slip-on sneaker styles. Styles that might vary in as many ways as there are computer-mediated knitting patterns and stitches created to generate new models for kids.

For example, Rothy’s  special edition of kids’ shoes, in collaboration with the NY Times best-selling children’s book illustrator, Pete Oswald, generated four pairs of 8 different knitted, slip-on sneakers. The four model pairs (shown below) include: a purple cat (on one shoe) chasing the grey mice (on the other shoe), a monkey (on one shoe) picking bananas (on the other shoe), a mama elephant (on one shoe), showering her baby elephant (on the other shoe), and pink flamingos facing each other.

Oh, patents! Rothy’s shoes

Rothy’s shoes are vibrantly colored and green all over– with no contradiction in terms. Indeed, Rothy’s shoes are green because the uppers are knitted with fibers made from recycled plastic bottles. As a result, more than 30 million plastic bottles have been recycled and diverted from landfills since the shoemaker set up shop, three years ago. In turn, this manufacturing process contributes to the planetary effort to reduce the production of greenhouse gasses, assumed responsible for global warming and its effect on climate change.

The shoe knitting process, now commonly used by big brand name sports shoes (e.g. Nike flyknit), enables the manufacturing of uppers as a single piece, with no leftovers. This saves on all the waste associated with the prior state of the art of upper manufacturing, consisting in a cut-out process. A cut-out process, where shoe uppers are templated on a large sheet of leather, fabric or man-made leather, leaving many pieces of the sheet unused between each cut-out upper.

Rothy’s soles are also green, made of carbon-free, recyclable rubber and TPU (Thermolastic PolyUrethane), while the insoles are made from recycled foam, which is also washable. Indeed, Rothy’s shoes are completely machine-washable!

Rothy’s adult shoes come in just four styles: point, loafer, slip-on sneaker and flat. However, the new knitting process allows for a striking array of different colors and computer–generated patterns and stitches.

The basic design of Rothy’s shoes is patented in the family of US design patents, listed below.
As a reminder: “a utility patent” protects the way an article is used and works (35 U.S.C. 101), while a “design patent” protects the way an article looks (35 U.S.C. 171) [MPEP Chapt. 1502.01; [R-07.2015]].

Included below, the patent Figures 1 and 3, respectively showing a front right perspective and rear heel perspective of the Rothy's shoe design, together with corresponding images of the marketed Rothy's shoes. Both patent Figures are extracted from  USD844313S, the most recent member of the Rothy's US design patent family.

New Global Warming pages @ epa.gov

Copyright ©  Françoise Herrmann

The new epa.org (Environmental Protection Agency) web pages on global warming (minus three pages on Climate change home, Climate Science, and Climate change impacts) are up and running!

The great news is that no major political re-interpretation of scientific data has occurred. Even if activists would probably like to see more details and the mention of agriculture, included in the EPA’s statement of the sources of GHG emissions, the Overview of the sources of greenhouse gas (GHG) emissions clearly states, without the slightest ambiguity:
Greenhouse gases trap heat and make the planet warmer. Human activities are responsible for almost all of the increase in greenhouse gases in the atmosphere over the last 150 years.1 The largest source of greenhouse gas emissions from human activities in the United States is from burning fossil fuels for electricity, heat, and transportation.
Data on the share of GHG emissions is provided per economic sector (including industry, farming, transportation, commercial/residential, land use and electricity), as well as an analysis of the GHG warming potential. Indeed, the EPA climate change data has been updated with more recent reports and scientific data from the most authoritative sources of information, the IPCC and the EPA's own US Inventory of GHG emissions and sinks, rather than re-interpreted, as feared, according to stated positions denying the existence of global warming.

The US data on GHG emissions and sinks presented is also clearly stated as reported to the United Nations, per the binding agreement to the UNFCCC (United Nations Framework Convention on Climate Change). Thus, the EPA clearly mentions its compliance with provisions applicable to the rest of the world.

The Carbon Footprint Calculator tool is still there, with an even nicer interface!

As for the former chart on Global Carbon emissions from 1900 to 2008, showing the dramatic increase in carbon emissions with the rise of industrial activity in the 1950s, new updated information is provided for US Total GHG emissions from 1990 to 2015. Consequently, the Total US GHG emissions, 1990-2015 chart, now shows an equally impressive halt to the rise in US GHG emissions, beginning in 2007-08 when the world was alerted to the dangers of climate warming, arising from GHG emissions, and a new awareness, coupled with intensive mitigation efforts were deployed.

Indeed, the new chart is fantastic news on the power of a country to change the course of catastrophic trends, even if this is just a small beginning in the reversal of GHG emissions trends, considering how the global picture displays no such planet-saving dip in carbon emissions, estimated to represent 82% of GHG emissions.

GHG emissions data may now also be explored with a new EPA tool termed the GHG Data Explorer that enables to search for emissions of a specific gas, per sector, and for a given period of time.

Another new tool for calculating GHG emissions equivalencies, termed the GHG Equivalencies Calculator, is also provided to enable users to calculate how much GHG emissions a particular item generates in daily life. For example, 40 gallons of gas generates of 784 pounds of CO2 (carbon dioxide).  Conversely, if users have GHG emissions data, they might also calculate equivalencies to offset emissions using the controversial flexible mechanisms (flex-mex) for International Emissions Trading and the Global Carbon Trading Markets, built into the provisions of the Kyoto Protocol within the context of the UNFCCC.

When President Trump shocked the world with his forthright denial of climate change on the campaign trail (League of Conservation Voters, 2016), Chomsky (2016) suggested that the most pressing question was whether “he really meant what he said”, a suggestion which shocked even more people.  Nonetheless, this overhaul of the EPA web pages (minus a few links) tends to suggest that no such denial exists and that the EPA will not be dismantled anytime soon.

Woo hoo!

Global warming denial

Copyright © Françoise Herrmann

In a move reflecting the new administration’s denial of global warming all the pages of the Environmental Protection Agency (EPA) referencing climate change and global warming have been archived. A message is now posted on those EPA pages that reads:

This page is being updated.
Thank you for your interest in this topic. We are currently updating our website to reflect EPA's priorities under the leadership of President Trump and Administrator Pruitt. If you're looking for an archived version of this page, you can find it on the January 19 snapshot.

My guess is that it would be unwise to post any updates since nothing so clearly signifies denial. Additionally, this move at least has the advantage of circumventing a political interpretation of scientific data, which might otherwise endeavor to separate issues of pollution and clean air from the broader consequences of global warming and climate change.

But, I might be wrong, and eagerly await the new pages....

An inconvenient sequel

Copyright © Françoise Herrmann

10 years ago, former Vice-President Al Gore, delivered the message of climate change to the world in a beautiful documentary and book, both titled An inconvenient Truth. A year later, in 2007, Al Gore and the Intergovernmental Panel on Climate Change (IPCC) were awarded the Nobel Peace Prize in connection with this message. Although the effects of greenhouse gasses on the climate were known well before the publication of this book and release of the documentary, no one had really understood the urgency of the situation or felt compelled to take action.

Thereafter, this much changed on a planetary level. Whether it was Energy Star appliances in the home economics department, idle functions on laptops, solar energy initiatives, the widescale adoption of hybrid cars as a step towards electric ones, or flyknit uppers on sports shoes, everyone both personally and collectively began taking steps to reduce their fossil fuel footprint. On an international level, the largest industrial polluting nations of the Northern hemisphere also began taking responsibility for creating an increased threat of famine and hardship, arising from ever greater climate changes in the Southern hemisphere.

Now, mark July 28, 2017 in your agendas as the release date of An Inconvenient Sequel: From Truth to Power,  a documentary that promises to be at least as game-changing as the first.

In any event, green might be staying, contrary to what was feared at Patents on the soles of your shoes in the aftermath of the Nov 2016 elections.

Green gone grey post Nov. 2016 US elections?

Copyright © Françoise Herrmann

The UNFCCC - COP22 (Conference of the Parties to the United Nations Framework Convention on Climate Change), held this year in Marrakesh, Morocco, ended on Nov. 7, 2016, just one day before voters elected Mr. Trump as the 45th President of the United States.

During the presidential campaign, President-elect Donald Trump expressed the following position and opinions about climate change:
“I’m not a big believer in man made climate change. There could be some impact, but I don’t believe it’s a devastating impact … I would say that it goes up, it goes down, and I think it’s very much like this over the years. We’ll see what happens. I mean, we’ll see what happens. Maybe you and I – even you, as young as you are – you won’t be around to see. But certainly, climate has changed. You know, they used to call it global warming. They’ve had many different – they call it extreme weather. They always change the name to encapsulate everything.” interview [Miami Herald, 8/11/16]
“This very expensive GLOBAL WARMING bullshit has got to stop. Our planet is freezing, record low temps, and our GW scientists are stuck in ice.” [Donald Trump Twitter, 1/1/14]
“It's really cold outside, they are calling it a major freeze, weeks ahead of normal. Man, we could use a big fat dose of global warming!” [Donald Trump Twitter, 10/19/15]
“The concept of global warming was created by and for the Chinese in order to make U.S. manufacturing non-competitive.” [Donald Trump Twitter, 11/6/12]
[Quotes extracted from: League of conservation voters (Oct. 2016) – In their own words – 2016 Presidential candidates on climate change http://www.lcv.org/assets/docs/presidential-candidates-on.pdf ]

Does this mean that the US is slated to become color-blind, and that the new color green is going to be grey, like the color of greenhouse gas (GHG) emissions, for the next 4 years? Is this for real?

According to Noam Chomsky, in response to a question on the long-term consequences of a Trump administration:
“First we have to ask if he means what he is saying... And if he does, then not only we, but the human species is in very deep trouble.”  (Chomsky, 2016)
Indeed… the above-cited President-elect electoral campaign remarks and opinions are not only disturbing, they are backed by an even more unsettling policy agenda which includes such items as: 1. a pledge to revive the US coal industry; 2. a vision of the US as a leader in fossil fuel production with an expansion of both onshore and offshore drilling and, 3. a plan to dismantle, or greatly cut back on the activities of the US Environmental Protection Agency (EPA). All of which arises in direct and complete opposition to internationally binding climate change decisions and agreements. First, beginning in 1994, with the ratification, and quasi-universal acceptance of the United Nations Framework Convention on Climate Change (UNFCCC), an agreement whose essential goal is to prevent “dangerous human interference with the climate” and that brought together 197 countries party to the Convention.  Secondly, the Kyoto Protocol in 1997 which set internationally binding emissions reduction targets for all the 197 countries party to the UNFCCC.  And finally, in stark denial of the UNFCCC – COP21 - Paris Agreement, ratified on Dec. 12, 2015, and now in force, 113 countries of the 197 Parties to the UNFCCC having already signed the agreement which calls for keeping the rise in global temperatures this century down to less than 2 degrees Celsius above pre-industrial levels, and if possible even down to 1.5 degrees Celsius.

As a result of such denial, responses to the new grey color of climate change have ranged from raw despair, fear and anger on the part of climate change activists, to a more tempered, firm and hopeful response on the part of scientists and current climate change policy makers, who complacently believe that their indisputable data on climate change and global warming will ultimately be recognized --once the new administration is in place.

In other words, and as Chomsky put it, activists definitely believe that the President-elect “means what he says” and that the US is on a new path to opt out of all previous international climate change agreements, whereas scientists and climate change policymakers think the President-elect “can’t possibly be meaning what he says”, considering the amount irrefutable data on global warming, produced by such widely recognized and reputable institutions as: the US EPA (Environmental Protection Agency), The World Meteorological Organization, the CNRN - Centre national de recherches météorologiques (France), Environment and Climate change Canada, the UK Met Office, plus many more.

As Daniel Kammen, science envoy for the U.S. State Department, Professor of Energy at the University of California at Berkeley, has responded:
“To be a climate denier in 2016 is to simply ignore science. A businessman is supposed to be flexible and thoughtful about opportunity. Clean energy is an economic boom, and it’s a boom for equity around the planet. And to turn your back on that is to put ideology over simple, good clean energy business and clean energy jobs.” (Democracy Now!, Nov. 15, 2016)
So, at the end of the day, do we, translators, all update our term bases with the term “grey” instead of “green” in reference to technology and patents that seek to both reduce global warming and/or mitigate its effects?

Well, it is perhaps too early to tell, since the US has just entered the transition period between administrations, before the January 20th, 2017 inauguration day. What is certain, however, is that the President-elect’s opinions and remarks are both misguided and the reflection of a true misunderstanding of global warming and climate change.

Such statements as: “This very expensive GLOBAL WARMING bullshit has got to stop. Our planet is freezing, record low temps, and our GW scientists are stuck in ice” uncover several important misconceptions of global warming, climate change and the science that drives the interpretation of planetary temperature.

First, scientists understand climate change as a result of global-warming, and not vice versa. Scientists understand global warming as a phenomenon arising out of the accumulation of greenhouse gases (GHG) such as carbon dioxide (CO2). In other words, it is not the weather that is responsible for global warming, it is our fossil-fuel and heavy emissions industrial activity, and more particularly the industrial activity of the Northern Hemisphere, that is assumed responsible for the accumulation of GHG, which in turn has steadily augmented the temperature of the planet. A record streak of freezing temperatures in New York City, Paris or Vienna will not “cool” our planet, just as a record heat wave in Detroit, Chicago or Southern Europe will not “increase the temperature” of our planet. These exceptional climate events are the consequences, not the cause of global warming, especially when recorded as increasingly frequent phenomena.

The following glossary entry on “Global Warming” extracted from the EPA Student’s guide to Global Warming clearly explains the relationship between global warming and climate change (italics mine):
Global warming: An increase in temperature near the surface of the Earth. Global warming has occurred in the distant past as the result of natural causes. However, the term is most often used to refer to recent and ongoing warming caused by people's activities. Global warming leads to a bigger set of changes referred to as global climate change.
Secondly, a warmer planet does not mean just warmer weather, it means an increase in the frequency of extreme weather and catastrophic weather events, such as for example, an increase in both the number and intensity of hurricanes arising from the increase in ocean temperature; a record number of tornados, an increase in rainfall and floods by almost 20% in the last century, and an increase in snowfall and resulting damages, pointing to “weather gone-crazy” in the Northern Hemisphere, and to the disappearance of lakes and increased droughts in the non-industrialized Southern Hemisphere generating increased suffering from the resulting shortages of both food and water supplies. However, these points are truly nothing new. This is a message that was already delivered loudly and very clearly in 2006 by Former Vice-President Al Gore in the book and non-fiction documentary titled An inconvenient truth: The planetary emergency of global warming and what we can do about it.

In fact, this message was powerful enough to generate a quasi-universal response, consolidating the action of 197 countries in the fight against global warming and its consequences (Lapowski, 2016). All of which makes the President-elect's remarks all the more disconcerting.

The hope then, as far as translators and interpreters are concerned, is that we might be commissioned to build more communication bridges in educational campaigns designed to gain the support of “climate change deniers”, whose loudest and winning representative is about to take the highest office.

If the new grey color of green is just a misconception, then there is still a place for reason, and for hope. Indeed, if President-elect Donald Trump really meant what he said when he asserted:
“I think that clean air is a pressing problem. You want to have clean air, clean water. That's very important to me, and I've won many environmental awards. I am not a believer in climate change,’ [Politico, 9/24/15 in League of Conservation Voters, 2016]
then it won’t be too difficult to reconcile the contradiction expressed above, so that green, clean and renewable energy remains the true color of climate change and the fight against global warming. 👠

Oh, patents! Nike Flywire

Copyright © Françoise Herrmann

Ever wondered about the suspension cables that criss-cross the uppers of your Nikes? They may appear in various configurations as embroidered threads into the upper’s fabric, as ridges sitting on top, or as strings extending from the lacing apertures that you could almost pluck, sometimes sandwiched between two layers. That’s Nike flywire technology!

Flywire technology with its two sets of crisscrossed strands (41 and 42 on the figure drawing  is primarily designed to provide lightweight containment within the void of the shoe, so that your foot does not slip and slide off the sides of the sole or roll forward, especially when the upper is also made of lightweight and form-fitting or stretch material. In patentese, you might say that this is considering "the sole and upper are cooperatively connected."

The crisscrossing and strategic positioning of the strands relative to the anatomy of the foot-in-motion are engineered so that the force load of each thread is known, and the spacing of the threads can be calculated.

In the latest models, the threads are made of Vectran™, a fabricated liquid crystal polymer (LCP) fiber,  which has a tensile strength 5 times greater than that of steel and a thickness the size of a human hair! So that when these wires are incorporated into the upper, they provide stronger support that any other sort of materials previously used for maintaining upper support such as leather, polymer sheet layers, textiles or synthetic leather.

There are however significant added benefits to the incorporation of flywire technology into the uppers of hundreds of Nike shoe models, chief among which is a concern for the sustainability of the shoe manufacturing process.

Indeed, according to US20120023778 titled Footwear incorporating angled tensile strand elements, where this technology is disclosed,  each material used in the upper of a Nike shoe has a specific function: textiles for breathability, foam compression for comfort, leather for durability, the combination of which adds weight, complexity and waste to the manufacturing process. That is, considering that the various material parts have to be cut, superimposed or connected together to form the upper.

Thus, because of the ease with which flywire technology is incorporated directly into the fabric of the upper, whether woven or knit, it does not add waste or complexity to the manufacturing process. The upper requires a certain amount of thread with no “leftovers”. And whatever is used is usually qualified as “ridiculously light”, which means that athletes have less weight to carry, and thus the added capacity to perform better.

So, if you are looking for green technology… The sort that is surreptitiously part of a planetary effort to cool planet Earth, to reduce waste and emissions of greenhouse gases, then you might consider Nike flywire tech!

The Abstract for US20120023778 titled Footwear incorporating angled tensile strand elements is included below as well as some of the figure drawings.
An article of footwear may include various first strands and second strands. The cutting and second strands may extend from an area proximal to lace-receiving elements to an area proximal to the sole structure. The first strands may have a substantially vertical orientation and the second strands may have a rearwardly-angled orientation. The first strands may be located in a midfoot region of the footwear and the second strands may be located in both the midfoot region and a heel region of the footwear. Angles between the first strands and the second strands may be at least 40 degrees. Additionally, the second strands may have at least fifty percent greater tensile strength than the first strands.

Blogs - Saint Gobain’s Cities and Buildings of Tomorrow

Copyright © Françoise Herrmann

World leader in the domain of building materials and in particular high performance materials serving comfort (i.e.; acoustic, visual, thermal and air quality) and energy efficiency (i.e.; green, clean and renewable), the Saint Gobain Group has filed more than 300 patents just for its glass building materials, one of which is competing for the 2015 EPO Inventor Awards in the industrial category.

Dutch Windwheel
Oxygen Eco-Tower
If you are interested in seeing some of the most spectacular and future-oriented cities and buildings of the world, login to one of the Saint-Gobain blogs called Cities and Buildings of Tomorrow…! You will discover plans for skyscrapers which cast no shadows, for they are built in pairs, each so that the sunlight reflected by one building fills the shadow of the other building! You will also find out about Dubai’s plans, to build a museum of the future in the Persian Gulf area, using 3D construction methods (see 3D construction patents here). You might see images of the Oxygen Eco-Tower in Jakarta, Indonesia, a 75-storey apartment building that stacks tropical gardens and dwellings at each level, or you might also see the Dutch WindWheel, which is both a wind turbine and a circular apartment building!

Cities and Building of Tomorrow showcases the stuff of architect and engineering dreams….. already erected or at the planning stage – each subsuming the use of state of the art, highly patented building materials, many of which were invented by the Saint-Gobain Group.

Versailles Palace - Hall of Mirrors
And just FYI, Saint-Gobain, was the secret location of France's King Louis XIV's mirror glass workshop, which manufactured the Versailles Palace Hall of Mirrors -- 350 years ago! The location, north of Paris in the Picardie region, was selected in part because of its proximity to the River Oise and the possibility of transporting the large sheets of mirror glass to Paris via waterway.

King Louis XIV granted letters patent, in 1665, for the exclusive Royal Manufacture of glass, a move designed to stave off competition from the Venetian glassmakers. "

Oh patents! Green, what’s green?

Copyrights © Françoise Herrmann

Emeralds, duh!..
.
All that is green, as in the green economy, green tech and green patents is connected to global warming, assumed to arise from the accumulation of greenhouse gasses (GHG) in the atmosphere.

The accumulation of greenhouse gasses in the atmosphere arises as a consequence of burning excessive amounts of fossil fuels (such as gas, coal and oil). Fossil fuels are also called “dirty” fuels in contrast to “clean” green fuels which do not produce emissions of gasses with a greenhouse effect. .

The quest for finding sustainable solutions to the problem of global warming and the consequences of climate change are part of a geo-engineering framework, and the IP solutions presented within this framework,  as inventions or patents, are all designed to address global warning in their own very different ways.

The WIPO green portal (World Intellectual Property Office, under the auspices of the United Nations) offers a green marketplace portal for the exchange of green technologies, knowhow and IP, with six particularly useful categories for the various areas of green activity.

These six areas include:

1. Alternative energy production
2. Administrative, regulatory or design
3. Waste management
4. Transportation
5. Energy conservation
6. Agriculture and forestry

It is well worth exploring each of these categories to critically discover and understand the implications of some of the types of inventions connected to global warming, and invoked in each of these areas of activity. Emissions trading, for example, is part of the second above listed categories, namely --administrative, regulatory or design activity invoked in the efforts to curb global warming.

Succinctly, lets see how green is green in some of these categories --not necessarily in the exact same order.

Caution...there are also unintended consequences…
The Irish are going to have several field days... ..!
 No duh!
