Oh, patents! Menier's Bouisset ads

Menier commissioned the artist Firmin Bouisset to advertise for the company's new chocolate bars. Bouisset depicted his daughter Yvonne writing "Chocolat Menier" on the wall with a chocolate bar. Alternatively, Yvonne is depicted writing "Évitez les contrefaçons" (Beware of counterfeits), an important message, on which Menier had built its pharmaceutical reputation.

For pharmaceuticals, this meant guaranteeing the purity and source of the ingredients processed as powders, so that they might be effective products. 

For household chocolate, this meant providing quality chocolate bars produced without substitutes for cacao, which was an expensive imported raw material. It also meant recognizing counterfeit wrappers where Menier's name might have been replaced with misleading versions. For example, court records exist for counterfeit wrappers using the names  "Murier, Meunier, Meinier, Nemier, Merier and Nenien" in place of Menier, on otherwise identical Menier chocolate bar wrappers displaying the company's first two medals awarded, or embossed on the bars.

Oh, patents! Digimarc® steganography (2)

The term steganography [stegano + graphy] has a Greek root steganos, meaning covered or concealed, and the suffix graph, meaning writing or graphic. 

The oldest record of the term steganography, per the OED, dates back to a book of magic and occult writing, in three volumes, titled Steganographia, written by a German Benedictine Abbot, called Johannes Trithemius, circa the year 1500.

To date, the term steganography refers to the process of hiding secret messages within a text. Recall the very recent (2017) example of UC Berkeley Professor Daniel M. Kammen’s letter of resignation, as US State Department Science Envoy, following US withdrawal from the Paris Climate Agreement, and in the aftermath of the White Supremacist rallies in Charlottesville, VA. The letter, addressed to the POTUS 2018, concealed the secret message IMPEACH, when reading the first letter of each of the letter’s seven paragraphs, (Wang, A., The Washington Post, Aug. 23, 2017).

Considering the 15th-century origins of the term steganography, Digimarc® watermarking technology has deep roots. When Digimarc® technology imperceptibly alters an image, for example every 100th pixel, and provides means to detect and read the distortion introduced in the text or media material, it is also concealing a secret code or message within a text. Whether this is a print, audio or visual watermarking, digital stenographic processes might be invoked for copyright purposes, identification, authentication, security, or to prevent the leakage of sensitive information and the proliferation of counterfeits, especially banknotes and ID cards or passports.

Indeed, several of the Digimarc® patents actually use the term steganographic processes. Balenciaga Bazar Totes!

The Balenciaga Bazar Tote series celebrates those used in South-East Asian markets. Whether it is in the Philippines where they are called Palengke bags, or Thailand where they are called Sampeng bags, these large versatile totes, made of synthetic polypropylene inspired Balenciaga collections on the 2016 runway. 

Are these bags legitimate? 

According to the Thai Department of Intellectual Property: "It's unlikely anybody can sue Balenciaga because the materials and shapes are different." (Vogue UK, 2016). Indeed, according to RealStyle (2017), the many upgrades of the Balenciaga Bazar totes, such as the stitching of each individual stripe, the inside lining with leather trimmed pockets, both zippered and patch, as well as the logo, appearing on the front of the Balenciaga Bazar totes, would also preclude it from being considered counterfeit. The point of a counterfeit, according to RealStyle, is for the fake to pass as another brand, so the branded Balenciaga totes are indeed genuine Balenciaga totes.

A point which the voices of dissent (i.e.; of the disenfranchised) might see in a completely different light... since branding and ownership of the design might be argued as precisely the point of contention. As for the stitching of the Balenciaga Bazar totes, which is noticed by those skilled in the art, since the stitching at the perimeter of the bags purposefully appears in white, rather than "tonal" (meaning that the stitches do not blend in), and with a low number of stitches per inch to emulate the cheaper South-East Asian versions, this might precisely be construed as the perfect proof of  counterfeit. 

However, beyond arguing fake and real, considering the position of the Thai Department of Intellectual Property, the deeper issue that polarizes is that, according to the World Bank, half of the poorest people on earth, living on less than $1.90 a day, are found in South East Asia. The question of legitimacy then could be re-framed as what might be done with the bags.
